can H1B holder receive commission payment (use form 1099)?

I have an interview today for change employer. The new company wants to pay me as a contractor that the company doesn't pay any social care and medicare tax. The employee ( me ) takes care all his/her social and Medicare to the government because I was told that all staff members in this company do the same way for their taxes. The accountant of this company insists on this way should work on my case.
I am H1B holder 8th year and lost my job at the end of last year but still do some work for my last employer and get payment as a contractor. My last employer hasn't tell USCIS that i am not work for him as a permanent employee.

Can I receive the payment as a contractor and pay my social care and Medicare by myself use form 1099?
