我的情况：今年1月20号被解雇，2月20号提交了H1B transfer， 申请中注明了计划3月16号开始新工作，种种原因现在还没上班，H1B transfer也还没批下来。原I-94今年9月30到期。我的问题是：
1。在H1B transfer 批下来前，我是否可以一直不用上班？

2。我的H1B transfer 算是 timely filed 吗？
_technically, no. But practically, you are fine because only one month from you were laid off to you filed the transfer may not have any negative effect on your H1 transfer.
如果我的申请被拒绝，Unlawful presence 是从1月20算起，还是从被拒绝的那天算起？
-You will be counted out of status from the date of the transfer denial, but your unlawful presence will be counted from the date of old I-94 expiration (Sept. 30).
