急问Pjiang及其他朋友，关于H1B transfer and unlawful presence, many thanks!

我的情况：今年1月20号被解雇，2月20号提交了H1B transfer， 申请中注明了计划3月16号开始新工作，种种原因现在还没上班，H1B transfer也还没批下来。原I-94今年9月30到期。我的问题是：
1。在H1B transfer 批下来前，我是否可以一直不用上班？
2。我的H1B transfer 算是 timely filed 吗？如果我的申请被拒绝，Unlawful presence 是从1月20算起，还是从被拒绝的那天算起？
