h1-b 身份问题

我去年公司申请将我的TN转为H1b。 TN在9月15日到期， h1-b10月1日生效。 但是律师说没关系，就没为我做TN延期。 我就继续工作至今。 最近我才发现我的h1-b签证要离境再入境才激活。现在算来已经无身份工作8个月了。我现在已近绝望了·不仅会被拒而且面临3年禁止入境， 绿卡的希望彻底没戏了。
各位有没有遇到这种情况的？ 请赐教。
