我2001年7月得到H1批准, 同时被lay off. 所以基本上没用上一天H1.在以后如果需要, 我可以任何时候把2001年的老H1激活.
-I do not think your can 激活2001年的老H1 because you did not work for that H1 at that time (that means you had never had a H1 statu yet).

公司律师说我不用申请新的H1了. 如我申请绿卡, 我可以直接申请劳工卡.
-You can file PERM/I-140 with TN status, but you can not file I-485 and EAD unless you use EB1 category (Priority Date i current). Also, if you file I-140, you can not extend your TN status any more and you can not go out of U.S (when you go outside of US, you will lose your TN status).
