H1B and CEO

I am current on H1-B and I started a company in USA. My company just acquires a public company. My investors told me that I couldn't become the CEO of this new public company because I am on H1-B. Does anyone know whether this is true or no. If it is true, is there any way I can work around this. Any answer is highly appreciated.
