急问：４８５ pending，h1b 转 h4

已经做为dependent 交了４８５，最近被lay off，想找到下一份工作后还保持h1b身份，中间的gap是不是一定得转成h4啊？可是５３９表格有问及是否交了４８５，如果是要 ＂describe the circumstances in detail and explain on a separate sheet of paper"，会不会影响已经交了的４８５啊？
主要是交了的４８５是eb3，想保持h1b交eb2.多谢！！
