Help! H1B status, will be laid off in a month

I have not applied EAD yet and will apply on Monday. EAD will take more than a month to get. During the time gap (after laid off and waiting for EAD), am I legally stay in the US? Only apply EAD is enough? Do I need to apply H4, since my wife is H1? Millions thanks.
