H1B layoff, 办niw的问题，恳求高手指点迷津

我在准备递交niw申请前夕被laid off，不知道我还能不能申请niw。据说在申请时只要有“工作意图”就可以，而不一定要有工作，不知道这种说法对吗？另外我什么时候可以申请EAD？是不是必须140批了，485交了以后才可以？假如有了EAD以后，我还需要H签证吗？另外EAD是不是也不一定能被获准的？
