H1B transfer with a 2-month gap, how risky is it?

I was laid off in October, now I just got a job offer last week. Till my H1B transfter be filed, there will be a roughly 2-month gap.

The employer laid me off havn't and probably will not notify USCIS.

I am wondering how risky my H1B transfer is.
