请问如果FILE MTR 或 APPEAL, 在PENDING其间我可以合法工作吗?

我的PERM是去年九月申请的, 可以先申请UNPAID LEAVE 回国, 等到绿卡申请满1年后从新申请H1B EXTENSION 吗?
我太太是H1B身份, 可以先换成H4不回国, 等到绿卡申请满1年后从新申请H1B EXTENSION 吗?
- 均可, actually you may apply right now with a starting date later than Sep.
