4月1号industry H1B申请，律师非要申请straight h1b，要求十月1号离境。请分析

我现在是大学H1B VISA(第三年)，WILL EXPIRE IN JULY 2008. 明天学校递交h1b延期申请(extended through october 1st 2008). 同时公司正在申请占GAP的H1B，准备3月31号递交。

公司律师担心我七月到十月之间有GAP，而且从明天FILE H1B EXTENSION 算起，不可能在四月1号前拿到 RECIEPT,因此要为我申请STRAIGHT H1B， 就是说INDUSTRY H1B APPROVED 后 我要离开美国 TO ACTIVATE INDUSTRY H1B。

请教大家

(1) What is straight H1B?

(2) In what conditions, I do not have to depart U.S?

(3) My university h1b extension will be filed tomorrow. university would like to provide evidence, (offer letter, FEDEX tracking record, letter certifying that i have filed h1b extension petition), but lawyer said these wont work? Any suggestions?
