2)bottmline, if have to leave US, could A come back after 1140 gets approved
can work then, (hopefully leave US for few months)
- you may come back to US at any time.
you may apply H-1 again by 12/08 if I-140 has not yet approved

is it required to stay abroad 365 days even i140 is approved ????
