AP, 485 和H1B的问题

请问各位热心人：
我有2个485申请（NIW和PERM)，同时也申请了2个AP. 我本来准备12月用AP回国一次，但
我的律师建议我回国后申请H1B回美国，“If you use NIW AP to come back, you are in I-485 (based on NIW) pending status and no longer in H-1B status. Moreover, your I-485 based on PERM is abandoned. I suggest you to come back with an H-1B visa and you preserve your H-1B status as well the pending of both I-485s.”


请问：1）两个AP是 mutual exclusive的吗？用了其中一个会imply 取消另外一个485？
2）我看到其他人说的是如果用AP回来，H1B如果是给同一个公司工作的话，那么还是属于H1B身份。我现在被律师搞得很迷惑了。
