- For stock investment, it's legal regardless your status, and you need to file tax return.

For being involved in a business trade, I don't think it is legal. While, I would say it's ok since no one knows it, and no SSN involves, thus no return involves.

There had been a discussion on eBay business, which did not come out any conclusion. 1) People can't tell the items they sell on eBay are garage sell (get rid of something in house) or business activity (buy and sell for profit); 2) When registering with eBay, an SSN is not mandatory so no information maybe communicated with IRS.
