Your biggest problem is I-140 not yet approved after 15 months. So you are vulnerable.
1. yes, because only then you are eligible to H-1 transfer to a new employer. Otherwise, the H1 status gap will prevent your H-1 transfer without leaving the US. And you can only rely on I-485 pending.
If your I-140 got approved, you are home free (even with no H1) because you are protected by AC21 portability.
