Urgent: Can I apply H1b with 485 pending?

My 485 is already pending for 4 years, my hu*****and is primary applicant, his 485 approved 2 years ago.

since now I only have 485 pending status, and I am afraid if my 485 is declined I would be illegal. Can I apply for H1b now?

I am currently working with EAD.
