Help with H1b transfer

Can anybody tell me whether a H1b transfer from a non-profit university to a profit industry positon will be affected by the exceeding of the cap or not? Thanks a lot.I saw the new declaration from BCIS. About H1b transfer, I don't know if I unstood it correctly, but it doesn't seem to specify whether it's a transfer between profit organiztion to a profit one, or non-profit one to profit one.
