No.
PERM needed to filed before the 5th year of H1, and then you can get 1-year extension beyond 6th year, one year after another. I-140 status (except denial) doesn't matter in this case.

Or if your I-140 is approved and visa cutoff date is not current, you can have 3-year extension, one extension after another. whether 365 days have lapsed doesn't matter in this case.
