You can file I485 after your priority date (the date you filed your I140, which is Jan, 2003, according to your post) become current on DOS bulletin.

If you go back, you can apply for an AP (file I131)
or you can bring your I797 for H1 to apply for a new H1 visa, and come back on H1. Either way will work.
