H1B Transfer pending I-140

I'm waiting for my I-140 approval but will leave the company in mid November due to layoff. RD of I-140 is June 28th,05. Although there is a slight chance that I can still get my I-140 approved prior to my layoff date, the lawyer suggests me start transfering my H1B to another company. His point is that my H1B transfer will not be noticed by INS so it won't affect my I-140 process immediately. If I get my I-140 approved before I leave the company, then I am fine. If not, I still have the new H1B visa to maintain the status.

What do you guys think? Anyone with similar experience?
