问一个indiana eviction的问题

需要evict 一个印第安纳波利斯的tenant, 一年的lease已经到期，现在是month by month, 已经欠了几个月的租金了，现在下了决心要驱除， 找了律师，律师说要先发30天搬家的notice, 因为lease上有写要terminate lease的话要给30天notice.  我的理解是我是要evict for nonpayment of rent, 为什么要先发notice to move, 直接发10 天notice不行吗？  是律师的做法对还是我的理解对？
