我是EB2降级EB3 申了I-140的, EB3和EB2的140都已经批了, 现在PD(按照port的当是EB2的PD) CURRENT了, 想FILE EB3的485, 那么还用附上EB2 140 approval notice(I797)吗? 还是就附EB3 140 approval notice? 多谢..
-Check the EB-3 I-140 approval notice to see whether the priority date (PD) is the same PD on the EB-2 I-140 approval notice. If yes, you only need to provide the copy of EB3 I-140 approval notice, and don't need to provide the EB-2 I-140 approval notice which PD is not current.
Otherwise, if the PD on the EB-3 approval notice is not the PD of the EB2 I-140, then USCIS will feel confused even if you provide the two I-140 approval notices and explain it in the cover letter. So, you had better contact USCIS to fix the PD of the EB-3 approval notice before you file I-485.
