Lawyer said EB3 is listed as "

Lawyer said EB-3 is listed as " unavailable", so I won't be able to file my I485(EB3) until several years later. The lawyer also mentioned that even we send the EB3-I485 to the CIS it will be rejected for sure.

However, The visa bulletion shows the immigration number for EB-3 (china) is May 2000 not the "U".

Anyone know
1. How they determine whether or not I can file the I485 (EB-3)?

2. Which information source do the lawyers rely on?
