EB2 or EB3?

Very small company (6 employees). Job title is senior software engineer. Job will need both hardware and software exp. Lawyer suggests me to ask for BS in the job description instead of MS because it will be hard to convince the DOL if they require proof of business necessity. I am still hesitating because it's gonna be a long wait for the EB3 priority date to become current. So,

1. Can I argue that due to the complexity of the job (need both hardware and software experience) a MS degree is required?

2. If I ask for a BS and 5 yrs exp, does that mean I need to have 5 years exp in both hardware and software or combined?
