回复：PERM申请问题(EB2)

现在准备申请PERM，现在是Faculty，律师准备有两点拿不准，请8老师：
 

１。我的招聘广告是电子的，是一个专业协会网，他们给我出示了证明，刊登的时间，30天等。律师说最好是能有screenshot的起始时间，说那证明他拿不准。
-I am not sure this. But I know DOL accept the advertisement in HigherEdJobs.com or chronicle.com (Chronicle of Higher Education website).
 

２。Another major issue with the advertisement is its lack of a defining minimum educational requirement for the job. The ad states that “[a]pplicants either have or be close to finishing a PhD in …” This could be seen, in the eyes of the DOL, as a failure to specifically delineate the minimum requirements for the position. This sort of “ABD” requirement is highly frowned upon by DOL and can be attacked by the officer as an insufficient educational requirements, which is necessary for the PERM. Needless to say, DOL is out of touch with modern higher education recruitment practices and standards.
 

我这种情况能proceed吗，还是再登广告啊？
-I agree with your lawyer. DOL is very picky and you should prepare the paperwork more carefully. So, you had better re-advertise the job in another website, etc.
