485 Pending, EB2, how to qualify instate tuition

Kid will go to instate university, we are filling the instate tuition application, How to fill the sataus in US(if filled with visa, eg, TD , I am afraid that we will not be qualified for the instate tuition) .Thanks for any suggestion.
