现在要提交I-140,公司又提出要签附加条款要我保证工作到2016年,如果我在2016年底前辞职或被辞退,则要退还自2006年加入公司以来,公司为我支付的所有H1B延期费用。
我最初的雇佣合同上没提到绿卡或者H1B的事情。雇用至今,公司使用在为我延期H1B时完全没有提过费用问题,包括使用express application service时也没有通知我。按照这个附加条款,如果我在2016年前离开,需要付给公司超过一万元 (包括律师费之类)。
请问这种要求工作期限的条款合法吗?
-It is illegal for the company to ask you to sign this agreement. Based on the immigration law, the employer needs to pay all the H1 petition fee including the attorney fee. Also, the law also requires the employer needs to pay all the fee for PERM including the attorney fee.
But no law requires the employer has to pay the I-140 filing fee indculidng the attorney fee.

-Tell your employer, you can not sign the agreement like that because it is illegal. Tell them you will ask your lawyer to dsicuss this issue with them.
