According to AC21, I-485 pending > 180 days. At the time of AC21 passed, there was no I-140/I-485 concurrent filing, so every EB485 can only be pending after I-140 approval.

After concurrent filing was allowed, several INS/USCIS memos cames out and the latest one wants the I-140 to be approvable with prepoderance of evidence at the time of I-485 pending 180 days.
