律师说IT(BS+5yr)的EB2现在劳工部很难通过，基本都要audit?

正准备perm,公司律师说最近劳工部很难通过BS+5yr的EB2(IT),都要audit，因为超过劳工部的normal reqirement for this job title(software engineer, it is jobzone 4, only need 2-4 yrs exper, and BS).以前只要雇主出具证明（business necessity），基本可以通过，但现在要求更多资料，并且律师说没有明确的标准和要求，一旦被拒，很难上诉。所以现在律师按EB3(BS+3yr)准备job requirements..不知是不是真的。大家有无这方面的信息？
