紧急，我还能申请EB2吗？

我目前在一国家实验室工作，现PERM已批。正准备提交I40. 才发现律师给我办的是EB3. 我有Ph.D. degree. 由于当初发广告时的工作要求是minimum BS degree， 所以该律师就按EB3去办了。他说现在已不能按EB2去办。请问有什么补救办法？ 我能自己申请NIW吗？
