yes. But will be tough to fight if AUSA bring up the visa issue. Recently one of our member filed WOM (BEFORE visa retrogression), then AUSA informed him that NC is cleared but unable to adjudicate the case because of visa, ask him to dismiss the case or he will submit Motion to dismiss
