Please help - any risk to have different lawyers for EB2 and EB3

Dear bro and sis,

I am in EB3 (perm) with PD Aug-2005. I am a MBA concerntration in Accounting. To play safe, i want to apply for EB2, then file I-485 with EB3 PD. Here are the questions
1. I don't like the EB3 lawyer. Can i go to another law firm for EB2? Any potential risk? I didn't change employer.
2. Can I file I-485 with EB3 PD after new 140 approval? The new lawyer called it a grey area. It was originally designed for RIR, but it doesn't strictly say that PERM switch cannot use prior PD. How do you interpretate?
