I'd work on the RFE, since all the cost has been paid already, for just in case the EB2 has some issue - no one can tell. Have something you can fall back on.

If you don't respond to (to be exact if your sponsor doesn't repond to) the RFE the 140 will be denied.

Post the exact wording in that RFE.
