请问EB3 to EB2

我的情况是这样perm (EB3) and I 140 in pending，但是现在EB3倒退的太厉害，所以想换成EB2.
我想问如果我在同一家公司the same position，重新办perm(EB2) and I140,can i carry on the old perm (EB3)PD吗？

If my company lawyer refuses to refile EB2 for me (since I am in the same position), what can I do? Can I hire my own lawyer?
