140 EB2 被拒，正在上诉中

140 EB2 被拒，正在上诉中， 如果AAO （Administrative Appeals Office ）还是拒掉，我要去Federal Court 打官司，如果我输了官司， 是不是马上得回国？我现在H1-B 第9年。
