FAQ #2. How can I tell if a case EB1, EB2 or EB3?

If the case did not involve filing an ETA 750 or ETA 9089 with the Department of Labor, then it must be EB1 or EB2.


If the case did involve filing an ETA 750 or ETA 9089, then it must be EB2 or EB3.


Look at the ETA 750, item #15 or ETA 9089 H.4. If the absolute minimum education required to satisfactorily perform the duties of the job offered is:

(a)PhD or Master's degree, then EB2; OR

(b)Bachelor's degree or no degree, then EB3.
