2. that is the decision of your employer. Not you or your lawyer.
3. and 5. The proposed position (if employer agrees) doesn't have to be your current one, or whether you have H1B or not.
4. if DOL or later during I-140 -- USCIS has doubt about whether this position requires one to have master's degree. They will ask your employer to prove it.
