EMPLOYEE (ALIEN)

To apply for a temporary work visa you must first find a qualifying job. Use
the links at right to have your resume reviewed and submit it to thousands of
prospective employers.

A number of documents are needed to complete the H1-B application process.
Below, you will find the information necessary to help us prepare your H1-B
application.

You will absolutely need an original passport or a notarized copy of your
passport.
A notarized copy of your prior Notice of Approval of "H" status (I-797), if
any exists.
A current resume including your a detailed history of your employment for the
last six years. This should specifically include the name of your employers,
addresses, and dates of employment.
Original I-94 Card or copy notarized on the front and back.
Original college degree and any certified transcripts from your school
Original credentials evaluation
Any license required for your particular occupation , if any
Any W-2 forms for the past five years, if any exist.
A record of any awards you have received as part of your education and
employment career.
The most recent pay stub from your current employer.
Your present address
Your previous foreign address
Telephone numbers for day or evening
Your social security number.
Copies of any existing employment agreements or contracts or offers of
employment.
The name, address and telephone number of your Employer
Your employer's Federal I.D. Tax Number
Your current or expected Annual Income
The number of Employees for the employer
The date including year that the employer established its business.
A detailed employment description including job duties and job title.
EMPLOYER

Each employer sponsoring an H1-B applicant must complete an I-129 form which
requires the following information:

Name, address, telephone number, and fax number of Employer
The year the company was established
The IRS tax identification number
The total number of employees
The gross annual income for the previous year
The net annual income for the previous year
Do full-time employees receive any type of compensation other than salary,
i.e. health insurance, dental insurance, etc. If so, what type of compensation
and what is the annual value of such compensation?
The name and title of the person form your company who will be signing the INS
petitions and their address (if different from above)

Sorry! I modified ilu's post a little bit without getting his/her approval in
advance. Here is the version for H-1B DIY for a company.

1. Form ETA9035

Before you start, read the following description at
http://ows.doleta.gov/foreign/h-1b.asp

On the site below, apply for LCA. You'll get a pdf file at last. Save it
and print it.

Regarding prevailing wage, DOL has its own online wage library, whose link is
at
http://www.flcdatacenter.com/owl.asp

The form can be submitted online or faxed. DOL responds very quickly. I wanna
say instantly. The form lists a term of up to 3 years, which is used by the
USCIS to determine how long a H-1B status is given.

Ask the head of HR to sign on the final certified copy.

2. Petition letter

This must be drafted in the name of the company. In the letter, the job
description, the beneficiary's qualifications, and the promise from the
employer must be specified.

3. List of documents in the package

From the petitioner: the employer

a. Filing fee of $185. Check is payable to US Citizenship and Immigration
Services. Personal check is accepted too. I mean, the beneficiary can write
the check too.
b. Form I-129 petition with H supplement and I-129W
c. Certified ETA-9035
d. Petition letter from the employer

BTW, a premium processing guarantees a response within 15 business days.
However, it needs a separate fee of $1,000 and a separate form (Form I-907).
Both Form I-907 and Form I-129 are downloadable from USCIS's website at
http://uscis.gov/graphics/formsfee/forms/index.htm

The above must be original. The head of HR can be the representative of the
employer to sign on the forms.

From the beneficiary

e. Copies of diplomas and transcripts. H-1B visa requires the beneficiary has
a BS degree. If the beneficiary has gained his/her degrees in the US, then
his/her diplomas and transcripts gained in China are not needed. However, it's
always good to include a copy of them in English and Chinese.
If the beneficiary has degrees from China only, the copies must be certified
by independent organizations, for example, www.wes.org.
f. Copy of resume
g. Copy of I-20, if the beneficiary is an international student
h. Copy of EAD card, if the beneficiary is on OPT practional training
i. Copy of I-94 card
j. Copy of passport, which shows the beneficiary is able to legally work in
the US for sometime, for example, longer than the time specified on ETA9035
k. Copy of current visa
l. Copy of social security card

The above can be photocopies. However, to be safe, a certificate of
authenticity signed and sworn by the head of HR can be included, as I did in
my petition.

big surprise to us. I don't realize it's so quick. Very happy.

以上的Fillable Forms可以直接用Google搜到，与我情况类似的H1B基本不用找律师（除非钱多了烧的），当然有的公司自己有专人办H1B，那就更好了。
关键是Employer的petition letter，一定要详细说明为什么公司非雇你，而不是别人，我花了两个星期和老板商量我的工作职责的描述，修改，请别人看...
$1,000的Additional Fee是不是都免－－不太清楚，反正单写一张支票就是了，Waive了他们会退回来。怕的是如果不免，而你又没寄，就耽误时间了。
Premium Fee看各人情况，申请前不知哪位发文分析说今年的限额要满了，搞得我紧张兮兮地申请Premium Processing。到现在还不知道今年的限额到底用了多少！估计年底前申请应该不会有问题。

I just received the approval notice email from Vermont Service Center, it
saying my H1B has been approved. That is so great!!! It could be the best new
year gift I ever received!!!

I started to DIY my H1B case since 12/02/2003. Here I would like to present my
faithful appreciation to downstreet and bballfan. With their clear and helpful
posts on BBS, it only took me less than two weeks to get all paperwork ready.
Even at that time, my company thought whether I should find a lawyer to do
that, but I insisted DIY (I would not pay that lawyer fee, I would not trust
those lawyers).

Fellow bballfan’s famous post “H1B自己申请”. Only one clear shot down H1B!
Here I will like to present my personal experience on H1B. If anyone want any
suggestion on H1B DIY, drop me emails. I will be more than happy to assist you
through. Come on, throw those lawyers away, trust yourself.

(如果有写的不清楚的地方，给我在买买提的信箱留言，我会尽量解释)

在开始行动之前，先去www.immigration.gov看看，了解一下办H1的基本知识。
然后找老板确定你的工作职责，内容，最好做成书面的在以后的过程中参考。再确
定公司即使不出钱起码提供相关文件，以及确定在PETITION上签字的人。

一步确定你的工资不少于PREVAILING WAGE的5%。 PREVAILING WAGE 可以从网上查http://edc.dws.state.ut.us/owl.asp ( 也许这个应该在接受OFFER之前做？)

然后申请LCA，Labor Condition Application - EAT9035,
也可以在网上办，http://www.lca.doleta.gov/ 大概半小时可以拿到。WAGE SOURCE 填 ONLINE WAGE LIBRARY。
不过如果职位与ONLINE WAGE LIBRARY 里的描述不是十分一致，建议找劳工部申请SESA，没有费用的。如果老板不愿意或者怕麻烦，找律师做很快，他们大概会收一小时的费用，当天或第二天能拿到文件。

然后填I129，I129W，I907(PREMIUM SERVICE REQUEST FORM)，可以从www.immigration.gov下载。I129W和I907可以用ACROBAT READER 填，I129不行，得先用ACROBAT做成表格。当然也可以选择用打字机填。其中一些内容要公司提供，诸如雇员人数，公司年收入，TYPE OF BUSINESS 接着写 COVER LETTER ，以公司名义写给BCIS。内容包括公司简介，财务状况，职
位的工作内容，为什么该职位需要学位，ALIEN(就是你)的学历，经验，为什么是
这个职位的最佳人选。

下来的东西就简单了，护照，签证，I94，I20，EAD，成绩单，学位，公司年底财务报告。

最后，最重要的，支票！

律师做的主要就是申请一份LCA，写COVER LETTER，如果你可以把其他做好，甚至COVER LETTER 也写好，然后请他给改改，REVIEW一下所有资料，加上申请LCA，大概一共付他两小时费用就可以了。
