我的EB1 485已获批，我配偶4月初以B2 visa来美，本打算7月给配偶申请485身份调整。但由于今年EB1从6月开始出现了排期，预期10月份才会回到current状态，所以我打算给配偶10月份申请。问题是我配偶的B2 VISA 10月2号就到期了，论坛里有人因邮寄延误导致错过时机的案例，所以我想提前几天寄出申请材料。请问：
1. 申请10月份的485身份调整，申请材料9月底寄达USCIS的话，会否因时间不对而被据？
-It is not good. The application materials must be received by USCIS on Oct. 1 to October 31. You may sent it out on Sept. 30 using overnight express mail.
2. 踩在B2 VISA到期的时间点上提交材料会不会有问题？
-No problem, especially there is 245(k) benefits for your wife's case (employment-based category), so it is fine even if a few days late for the mail received by USCIS..
