But if his green card is void (i.e. cannot get the permanent green card), then he can file I-140 to apply for a new green card. Because the problem is that he needs to have a non-immigant status such as H-1 before he can file I-485, so he may have to leave US and then, get the H-1 visa to reenter US if he lose his current green card.
