回复：请教关于EB1b和NIW的一个问题，可能有点复杂， 多谢各位大师

想请教一下一个关于Eb1B和NIW的问题。 从7月份EB1B 的I-140批下来以后，这个问题已经困扰了我五个多月了。

背景： H1B 到2011， FEB， 正在准备申请延期。

NIW， PD2007， Oct。 I-140 批准2008，Dec， 等待排期中。

       EB1b， PD2010， April， I-140 批准2010，Jul.

         

本来EB1B 是件好事， 虽然经过三个多月的准备， 但是顺利的批下来了。 可是由于雇主的原因， 到现在为止我还没有从雇主手中拿到 EB1B 的Approve notice.

 

问题：

1.       如果这个EB1B的I-140 approve notice 一直拿不到自己手中，

-Have you filed your I-485 yet?

 

  是否会影响NIW排期到了以后的I-485申请？

-No, it is irrelevant.

 

2.       如果这个EB1B的I-140 approve notice 一直拿不到自己手中， 是否会影响近期就要开始的H1B renew? (H1b renew 应该提供已经批准的I-140 approve notice)

-No,  it is irrelevant.

 

3.       如果这个EB1B的I-140 approve notice 一直拿不到自己手中， 并且会影响以上任何一项， 是否应该要求雇主撤回原申请？

-Nothing needed to do.

 

4.       由于批准后180天雇主就不能撤回申请，

-Not true. if you have not filed I-485 yet and the I-140 is withdran, you can not use this Eb1b anymore.

 

如果没有来得及撤回申请，是否会有任何负面影响？又有何对策？

 

5.       如果更换雇主，新雇主愿意帮助申请EB1B，那么如果重新申请，已经批准的Eb1B对于新申请是否会有不利影响？ 又有何对策？

-If you have filed I-485 for more than 180 days, you d not need to file a new one if your new job is in the same/similar area as the old job. If you do not file I-485 yet, you have no any problem to file a new EB1B (the old on edoes not affect the new one).

6.       过于目前状况处理的可能的最佳策略是什么？
