Thank for the input. In the application form, it asks for previous I-140 application. My lawyer said USCIS will always look at the previous application. My lawyer suggested that I should wait for half year and file again.

I don't want to wait. I wonder if I file a new EB1b application using premium service, will it be treated separately?
