Try to change your title to researcher.

You can use research-track instead of permanent. Don't mention any funding and term issues. You can say the organization will exercise any possibility to retain Dr.XXX for a research-track basis in your research area...

Post-doc does not qualify EB1B. However, you can ask your boss to change it to Research Engineer, Researcher, or Research Scientist, whatever you think it's better than research associate.

The help from your boss is a key point.
