EB1A 485 approved but 140 pending, error from USCIS?

I filed EB1A 140 and 485 concurrently in January 2008. My case was not updated till 06/23/2009.

For 140, LUD is 06/23/09 and it is : Current Status: Case received and pending.

On January 22, 2008, we received this I140 IMMIGRANT PETITION FOR ALIEN WORKER, and mailed you a notice describing how we will process your case. Please follow any instructions on this notice. We will notify you by mail when we make a decision or if we need something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. In most cases we know 140 is approved before 485 or concurrently with 485.
So is this an error from USCIS?
