特殊人才（ Alien of Extraordinary Ability），属于职业移民第一优先，不需要申请劳工纸也不需要雇主的工作承诺，可以自己提出绿卡申请。

申请条件:

CFR204.5(h)(2) 指出，“特殊人才”是“其专业能力达到一定水准，并成为该领域中少数的頂尖人物之一”（A level of expertise indicating that the individual is one of that small percentage who have risen to the very top of the field of endeavor）。

也就是说，要能符合杰出人才的移民资格，申请人必须享有国家或国际级声誉与成就, 并会对美国社会的相关发展，提供实质贡献。

第一类符合条件者是获得过一次国际性重大成就、或奖励、或重大发明创造的人才。例如：诺贝尔奖获得者、奥林匹克奖牌或奖杯获得者等。仅凭这一项国际大奖，就足以证明其杰出专业能力（One time achievement, such as a major, internationally recognized award. ）。

第二类的申请人是沒有得到过大型国际奖项，但具备下列三个条件以上来证明其特殊才能，也属第一优先的“特殊人才”。

获得过国家级或国际认可的奖励或奖章。（Documentation of the alien’s receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor）；

专业协会的会员证明。专业协会必须为要求其成员达到一定资历和水平才能加入的全国性或国际承认的专业性学会、协会、团体或组织；

因在本领的成就被报纸、电台、电视、或其它新闻媒体报导过；

在其领域內，曾经以个人或组员身份担任评审，评判过所属专业领域或其他相关领域內他人工作（比如，审委）；

在其领域內(包括科学，学术，艺术，体育或商业)内作出突出贡献（ Evidence of the alien’s original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field ）；

在所属领域內国际刊物或学术刊物上发表过论文（Evidence of the alien’s authorship of scholarly articles in the field, in professional or major trade publications or other major media）；

在国家级以上的艺术展览会上，展示过作品（ Evidence of the display of the alien’s work in the field at artistic exhibitions or showcases ）；

在享有很高声誉的组织或团体中担任过主要领导或担任重要职务（Evidence that the alien has performed in a leading or critical role for organizations or establishments that have a distinguished reputation）；

申请人的薪资、酬劳、工资远远高于同行的证明（Evidence that the alien has commanded a high salary or other significantly high remuneration for services, in relation to others in the field）；

在表演艺术上曾经创造相当高的商业价值，如票房收据、磁带、CD、磁盘、或录影带销售等（Evidence of commercial successes in the performing arts, as shown by box office receipts or record, cassette, compact disk, or video sales）；

其它类似的证据证明申请人的杰出才能。

如果还不符合某些条件，可有目的地创造条件，例如，加入专业协会，多发表文章，应邀担任评审等。

值得注意的一点是，所谓“特殊人才”不一定是有高学位的专家知识分子。那些身怀绝技的民间艺人，也许没读过什么书，也有可能属于“特殊人才”，如艺术剪纸，优秀的杂技艺人等，但要能拿出证明自己特殊才能的证据。
