If your hu*****and is holding H-1, so it's OK to file H-4 immediately. Normally, USCIS will approval the H-4 with the start time to be the 485 denied time. Then you will not be "black", but you can't work legally. Even now you are illegal due to the 485 deny.

So don't take chance to work any more, because your tax return will be checked when you pass through the 485 screening when you apply G with your hu*****and
