我是NIW主申请人。现在485 pedning 。老公现在用他的HI工作。现在他想用他的工卡给另外一家公司作part-time。
请问：1 他的身份是否变化？
-Yes, he will lose his h1 status if he use EAD to work.

 

2 他是否需要通知现任雇主(H1的那个):他开始使用工卡了，

 

还是什么都不用说？

-Fine.

3。他有什么风险吗？

-Don't think there is risk, especially he is not primary applicant in green card application. If his I-485 is denied, he just go to China to get the H1 visa to come back to reinstate his H1 status.
