Can your hu*****and apply H-4, even outside?

NIW is very risky, nobody is 100% sure.
In my case, I am also a postdoc at university.
Several industry jobs are gone because of no H1 or GC.
But I really do not want to use NIW-pending EAD.
So I have to wait until at least 140 is approved.
