I still believe they want the biometrics payment, because I believe you will need to do biometrics for this application, and the fee was not included in your original I-485 application, because it was filed prior to the fee structure being changed. We will see what they do with the second check and application that we sent, which we requested to be expedited. I have worked with USCIS/INS long enough to know they do make mistakes (especially at intake, where the workers are subcontractors and do not really know the law and its history).
